These Terms of Service (“Terms”) govern your access to and use of the4.co (the “Website”) and the themes, apps and services offered by The4, operated by Gravio LLC (“The4”, “we”, “us”). By accessing the Website or purchasing from us, you agree to these Terms. If you do not agree, do not use the Website or our products and services.

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to purchase from us. You are responsible for the accuracy of the information you provide and for keeping any account credentials secure.

2. Products and licenses

Our themes, apps, code, designs and documentation are the intellectual property of The4 and its licensors. A purchase grants you a limited, non-exclusive, non-transferable license to use the product in accordance with the applicable license terms (including the Shopify Theme Store, Shopify App Store or Envato license where relevant). You may not redistribute, resell, sublicense, publicly share or reverse-engineer our products, or use them beyond the scope of your license.

3. Services

Where you engage us for services (such as web design, theme or app customization, store setup, migration, speed or SEO), the following apply: the work is limited to the agreed scope; you will provide timely access, materials, content and feedback; revisions are limited to the number stated for the service; out-of-scope work requires a separate quote; and you are responsible for maintaining your own backups. Where possible we work on a copy or staging environment, but you remain responsible for your store and data.

4. Pricing, payment and taxes

Prices are shown on the Website and may change at any time. Quotes for services are estimates based on the information provided and may be revised if scope changes. You are responsible for any applicable taxes, duties or payment fees. Services typically require payment or a deposit before work begins.

5. Refunds

Refunds are governed by our Refund Policy, which forms part of these Terms.

6. Acceptable use

You agree not to use the Website, products or services for any unlawful, infringing, harmful or abusive purpose, and not to interfere with their security or operation. We may refuse, suspend or terminate service for breach of these Terms, non-payment or abusive conduct.

7. Third-party services

Our products and services may rely on or integrate with third-party platforms, themes and apps (including Shopify and third-party apps). We are not responsible for third-party services, their availability, changes or any conflicts they cause.

8. Disclaimer of warranties

To the maximum extent permitted by law, the Website, products and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant uninterrupted or error-free operation, and we do not guarantee any specific business result (such as sales, traffic, rankings or performance scores beyond targets expressly agreed in writing).

9. Limitation of liability

To the maximum extent permitted by law, The4 and Gravio LLC shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill. Our total aggregate liability arising out of or relating to the Website, a product or a service shall not exceed the amount you paid to us for the product or service giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless The4 and Gravio LLC from any claims, damages or expenses arising from your misuse of our products or services, your content, or your breach of these Terms or of any law or third-party right.

11. Termination

We may suspend or terminate your access to the Website or services if you breach these Terms. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability and indemnification) will survive.

13. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Colorado shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms, except where applicable mandatory consumer law provides otherwise.
